Terms of Service

Effective September 8, 2026 · Last updated September 8, 2026

1. Who we are and what these terms cover

Zoink ("Zoink", "we", "us", "our") is a peer-to-peer rental marketplace operated as a sole proprietorship by Vansh Parikh, located at 2 Goderich Drive, Brampton, Ontario L7A5A7. You can reach us at zoinksupport@gmail.com.

Zoink is not incorporated. The operator is personally the contracting party under these Terms.

These Terms of Service ("Terms") are a binding agreement between you and Zoink. They govern your use of the Zoink mobile application, the Zoink website, and any related services (together, the "Platform").

By creating an account, listing an item, booking an item, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

2. What Zoink is — and what it is not

Zoink provides a venue. We let people who own items ("Owners") offer those items for short-term rental, and let other people ("Renters") find and book them.

Zoink is not a party to the rental. When a booking is confirmed, the rental contract is formed directly between the Owner and the Renter. Zoink is not the owner, seller, lessor, bailee, insurer, or guarantor of any item listed on the Platform.

We do not:

What we do do: host listings, process payments, hold security deposits, provide messaging, publish ratings, and — where we choose to — mediate disputes about a security deposit under section 11.

3. Eligibility

To use Zoink you must:

The Platform is offered only in Ontario. We do not currently offer it anywhere else, and we do not intend it for use by anyone outside Ontario.

You must verify a student email address before you can list or book. See section 4.

4. Your account and verification

You must provide accurate, current information when you register, and keep it up to date. You are responsible for everything that happens under your account, and for keeping your password secure. Tell us immediately at zoinksupport@gmail.com if you think someone else has accessed your account.

One person, one account. You may not create an account on behalf of anyone else, transfer your account, or use another person's account.

Student verification. Before you can list or book, you must verify your account by confirming a valid post-secondary student email address. We send a code to that address; entering it verifies your account.

That is the only verification we currently do. We do not check government ID, we do not run background checks, and we do not run criminal record checks. A "Verified" badge means one thing: someone controlled a student email address at an Ontario institution. It is not an endorsement, a guarantee of honesty, or a statement that we know who that person really is.

We may introduce government ID verification later. If we do, we will update these Terms and the Privacy Policy and give you notice under section 19 before it applies to you.

5. Listing an item (Owners)

When you list an item, you represent and warrant that:

You set your daily price, your security deposit amount, and your stated item value. You are responsible for the tax consequences of your rental income; Zoink does not provide tax advice and does not withhold income tax on your behalf.

You may remove a listing at any time, but you must honour bookings that have already been confirmed, unless you cancel under section 9.

Photos you upload

You keep ownership of the photos and text you upload. You grant Zoink a non-exclusive, worldwide, royalty-free licence to host, store, resize, and display that content on the Platform and in Zoink's marketing, for as long as your content is on the Platform and for a reasonable period afterwards for backups and records. You can revoke the marketing part of this licence by emailing zoinksupport@gmail.com.

6. Prohibited items

You may not list, and may not rent, any of the following:

We may remove any listing, at any time, without notice, if we believe it breaks this section.

7. Booking an item (Renters)

When you request a booking, you are making an offer to rent on the terms shown at checkout: the dates, the daily price, the total price, the applicable taxes, and the security deposit amount.

A rental contract forms when the Owner accepts your request and payment is successfully authorized. At that point you agree to:

You must not use the Platform to arrange a rental and then complete it off-platform to avoid fees.

8. Handoff, condition photos, and returns

Zoink asks both parties to take photos at pickup and at return, and to confirm each handoff in the app.

Those photos and timestamps are the primary evidence we use in a dispute. If you do not take them, you may not be able to prove your side. A party who fails to document condition at handoff bears the practical risk of that gap.

Failing to return an item by the agreed return time may result in additional charges, capture of the security deposit, suspension of your account, and — if the item is not returned at all — referral to police as a possible theft.

9. Cancellations

Either party may cancel a confirmed booking at any time before the rental start time, in the app, at no cost. The Renter is refunded in full — the rental price, the HST, and the security deposit hold are all released. No fee is charged to either side.

Once the rental start time has passed, the booking is no longer cancellable. If the Renter does not collect the item, the rental is treated as having gone ahead and the normal rules apply.

Cancelling is free, but it is not consequence-free. Repeatedly cancelling confirmed bookings — particularly as an Owner, at short notice — damages the other party and may result in your account being suspended under section 15.

Nothing in this section limits any right you have to cancel under Ontario's consumer protection legislation.

10. Money: prices, fees, taxes, and payouts

10.1 Payments are processed by Stripe

All payments, deposit authorizations, and payouts are handled by Stripe. Zoink does not store your full card number. To receive payouts as an Owner, you must open and maintain a Stripe Connect account and accept the Stripe Connected Account Agreement directly with Stripe. Stripe's terms apply to you in addition to these Terms, and Stripe may refuse or close an account under its own rules.

10.2 What a Renter pays

A Renter pays the rental price for the booked dates, plus 13% HST. That is all. There is no separate service fee charged to Renters, and there is no protection or insurance fee.

HST is charged on the rental price only. It is not charged on the security deposit, which is a hold rather than a sale.

Separately, a security deposit in the amount set by the Owner is authorized (held) against the Renter's payment method. A deposit hold is not a charge, but it does reduce your available credit until it is released.

10.3 What an Owner receives — the commission

Zoink charges a commission to the Owner only. It is deducted from the Owner's payout, and it is calculated on the rental price, based on the listing's daily rate:

Listing daily rateZoink commission
$20.00 or less per day15%
$20.01 to $50.00 per day12.5%
More than $50.00 per day10%

The applicable rate is locked in at the time the booking is requested and shown to the Owner before they accept. The Owner's net payout is displayed in the app before acceptance.

Commission is charged on the rental price only. It is never charged on a security deposit or on damage compensation.

10.4 Payouts

After a rental is completed, the Owner's net payout is released to their Stripe Connect account following a 24-hour holding period. How long it then takes to reach the Owner's bank account is up to Stripe and the Owner's bank.

We may delay or withhold a payout while a dispute, a suspected fraud review, or a chargeback on the booking is unresolved.

10.5 Taxes

Rental prices are shown before tax, with 13% HST added at checkout. As an Owner, you are responsible for determining and meeting your own tax obligations on rental income, including whether you are required to register for and collect HST.

10.6 Changing fees

We may change the commission structure in the future. Any change applies only to bookings requested after the change takes effect, and we will give you notice as required by section 18.

11. Security deposits and damage claims

A security deposit is authorized at booking and can end up in one of three states:

To make a claim, an Owner must open a dispute in the app within 24 hours of the booking completing. After that the window closes and the deposit is released. A claim must include evidence — the handoff photos, the return photos, repair estimates, and anything else relevant. The Renter is given an opportunity to respond.

How Zoink decides. Zoink reviews the evidence and decides how the deposit is allocated. Our decision is final as to the deposit only. It is an administrative allocation of funds we are holding — it is not arbitration, not a legal judgment, and it does not decide who is legally liable. Either party remains free to pursue the other in the Ontario Small Claims Court or any other forum for anything beyond the deposit. We are not obliged to mediate every dispute, and we are not liable for the outcome of one we do mediate.

Damage compensation paid to an Owner is not commissioned and is transferred separately from the rental payout.

12. There is no insurance on Zoink

Read this section carefully, because it is the one most likely to surprise you.

Zoink does not provide insurance, damage protection, or any guarantee of any kind. We are not an insurer, we do not offer a protection plan, and we do not cover loss, theft, or damage.

The security deposit is the only financial protection in the system, and only if the Owner set one. If an item is worth $2,000 and the deposit is $100, the most that can be recovered through Zoink is $100. Anything beyond that is a matter between the Owner and the Renter, and is for the courts, not for us.

What this means in practice:

We may offer some form of protection product in the future. If we do, it will be offered under separate terms you actively accept, and it will not apply to bookings made before then.

13. Reviews and ratings

After a completed rental, both parties may review each other. Reviews must be honest, based on your own experience of that rental, and free of personal attacks, discriminatory content, private information about anyone, or anything unlawful.

You may not offer or accept anything of value in exchange for a review, or condition the return of a deposit on a favourable review.

We may remove a review that breaks these rules. We are not obliged to review, moderate, or remove any particular review, and we are not responsible for what other users say about you.

14. Things you must not do

You may not:

15. Suspension and termination

You may close your account at any time in the app or by emailing zoinksupport@gmail.com. Closing your account does not cancel bookings that are already confirmed, does not release you from money you owe, and does not remove reviews you have already received.

We may suspend or terminate your account, remove your listings, or refuse service, with or without notice, if we reasonably believe you have broken these Terms, that your continued use presents a risk to other users, or that we are required to by law. Where it is safe and lawful to do so, we will tell you why and give you a way to respond.

Sections 2, 10, 11, 16, 17, 19, and 20 survive termination.

16. Disclaimers

The Platform is provided "as is" and "as available." To the fullest extent permitted by law, and except for warranties that cannot be excluded under Ontario law, Zoink makes no warranties of any kind, express or implied, about the Platform, any listing, any item, or any user — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defect will be corrected.

We do not screen, endorse, or vouch for users or items. You deal with other users at your own risk. Meet in a safe, public place. Inspect the item before you take it.

17. Limitation of liability

To the fullest extent permitted by law:

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or anything else that cannot lawfully be excluded — including rights you have under Ontario's consumer protection legislation, which you cannot waive and which override any conflicting term here.

18. Indemnity

You agree to indemnify and hold harmless Zoink and its operator from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: your use of the Platform; any item you list or rent; your breach of these Terms; your violation of any law; or your infringement of anyone else's rights.

This does not apply to the extent the claim arises from Zoink's own negligence or wilful misconduct.

19. Changes to these Terms

We may change these Terms. If a change materially affects your rights or obligations, we will give you at least 30 days' notice by email and in the app, and we will ask you to actively accept the new Terms before you can continue to list or book. Bookings already confirmed stay under the Terms that applied when you booked.

Minor changes that do not reduce your rights — fixing a typo, clarifying wording, complying with a legal requirement — take effect when we post them, and we will update the "Last updated" date.

20. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction, and you and Zoink each submit to them.

There is no mandatory arbitration clause and no class-action waiver in these Terms. Ontario consumer protection law does not permit us to take those rights away from you, and we are not trying to.

Before starting a formal proceeding, please email zoinksupport@gmail.com so we have a chance to fix the problem.

21. Odds and ends
